Our law firm was co-founded by Todd Elliott, Esq., a North Hills resident and a litigator by vocation. He has 24 years of experience and chairs the litigation department in our seven lawyer firm.  Mr. Elliott handles contract disputes, serious injury claims, and business law disputes.

Since 1997, Mr. Elliott practiced civil litigation (plaintiff and defense) in state court proceedings throughout Western Pennsylvania. 

Training & Experience 

Mr. Elliott earned his Juris Doctor degree from the Duquesne University School of Law in Pittsburgh. He passed the bar exam in Pennsylvania and West Virginia. 

Mr. Elliott has significant experience throughout Western Pennsylvania, including not only Allegheny County (Pittsburgh) where he lives.  He also handles cases in the surrounding counties of Beaver, Washington, and Butler.

TWENTY-FOUR (24) YEARS of EXPERIENCE 

On the plaintiff side, Mr. Elliott received numerous six figure awards for clients involved in motorcycle and other accidents.  He handles complex commercial litigation.  He has handled difficult limited tort cases, where the injury driver elected limited tort versus full tort, limiting the available recovery, unless one of the statutory exceptions will apply, or it can be proven the injury was "serious," or if the injury was to a pedestrian or someone on a bicycle.

Several of his cases have been deemed “complex” and were handled through a separate division of the courts.

Having worked for two prominent regional firms, Mr. Elliott's areas of practice is civil litigation. This includes breach of contract, construction law, suits on home improvement contractors, mechanics liens, injury law (plaintiff and defense), professional negligence (plaintiff and defense), premises liability, unfair trade practices, trade disparagement, defamation, and multi-state litigation.

Over the course of his career, he has handled the mediation of disputes, several trials by jury, and appeals to the Superior and Pennsylvania Supreme Court.  He also served as an arbitrator in state court (similar to a judge), deciding actual cases.  Mr. Elliott also had the privilege several times of being asked to serve as a judge of national mock trial competitions at the collegiate level, which take place at the University of Pittsburgh.

Defense Experience.  On the defense side, our Pittsburgh lawyers have succeeded.  For example, Mr. Elliott has personally defended the outgoing CEO of Worldcom, Bernard Ebbers.  He had been sued in Pittsburgh for his alleged role in diminishing the value of Worldcom stock.

In another case, Mr. Elliott represented Nationwide Insurance Company when a group of Nationwide insurance agents broke off from Nationwide to form a new company. Allegedly, the new company competed directly with Nationwide.   Then, Nationwide filed suit in Western Pennsylvania against the former agents who, in turn, counter sued.  What resulted was  a prolonged legal dispute.  It involved claims (and counterclaims) for trade disparagement (defamation) and theft of trade secrets.

Also, Mr. Elliott defended a Colorado corporation on a breach of contract suit filed in Allegheny County. In that case, the lower court dismissed the case based on a lack of jurisdiction and improper venue.

Mr. Elliott ultimately argued the case before the Pennsylvania Superior Court. Likewise, in another breach of contract case, he represented a Las Vegas company concerning litigation in Pittsburgh. Regarding employees recently separate from a company, Mr. Elliott defends claims for non-compete agreement violations, plus variations of those, such as claims for theft of trade secrets, trade disparagement, and claims of solicitation of employees or clients.

On the smaller case side, Mr. Elliott regularly provides small claims court consultations, and defends those sued for a debt, including credit card debt disputes.

 

Bet the Business Litigation 

Recently, in the United States District Court for the Western District of Pennsylvania, Case No:2:20-cv-1654, Mr. Elliott defended a company Texas manufacturer called HHM.  A worker had his face torn off on the job.  It was six figure product liability claim in federal court.

In another case, we also defended a wrongful death lawsuit.  It was filed a guest who fell at a wedding on our client's premises.  The guest sustained fatal injuries.  We did, however, get the case resolved for an amount that allowed our client to remain in business.

 

Early Experience 

Upon graduating from law school, Mr. Elliott served as a judicial law clerk for The Honorable Peter O. Steege, Court of Common Pleas of Beaver County, Pennsylvania. He is a member of the Allegheny County Bar Association, Pennsylvania Bar Association (Civil Litigation Section), and the American Bar Association.

Lawyers, at table, profiled in the New York TimesIn addition to civil litigation, Mr. Elliott also possess experience representing clients in matters involving divorce, support, custody, PFA, and criminal defense.  He won a custody trial involving a dispute over the child’s religion.  Mr. Elliott also won a child support trial which the opposing party appealed to the Superior court, where Mr. Elliott prevailed again.  The case was profiled in The New York Times.  Mr. Elliott's closing argument was quoted at length.

Currently, he handles complex cases and manages his firm's litigation practice group.  He litigate cases in arbitration, jury and non-jury trials in Western Pennsylvania.
